Chama cha CUF kimepinga hatua ya tume ya uchaguzi ya kufuta matokeo ya uchaguzi wa urais
Chama cha Wananchi (CUF) kimesema hakitakubali marudio ya uchaguzi wa urais visiwani Zanzibar.
Chama hicho kupitia taarifa kwa wanahabari kimesema hakuna “hoja wala msingi wa kikatiba na kisheria wa uchaguzi kurudiwa”.
Taarifa ya chama hicho ambayo imesomwa na mgombea wa urais wa CUF katika uchaguzi wa 25 Oktoba mwaka jana Maalim Seif pia inaonekana kupendekeza mwenyekiti wa Tume ya Uchaguzi Zanzibar (ZEC) Jecha Salim Jecha ang’atuke.
Chama hicho kimemtuhumu Rais wa visiwani Mohamed Ali Shein wa Chama cha Mapinduzi (CCM) kwa kukwamisha mashauriano ya kutafuta suluhu ili ZEC itangaze marudio ya uchaguzi tarehe 28 Februari 2016.
CCM imeonekana kuunga mkono kurudiwa kwa uchaguzi visiwani na majuzi viongozi wa chama hicho waliwataka wafuasi wake visiwani kujiandaa kwa marudio ya uchaguzi.
Tangazo hilo lilishutumiwa vikali na viongozi wa CUF.

  Baadhi ya benki nchini zinadaiwa kuajiri baadhi ya wafanyakazi walio kwenye mtandao wa majambazi kutokana na wateja wengi kupigwa risasi na kufa wakitoka kuchukua pesa, uchunguzi wa baadhi ya askari wa Jeshi la Polisi Tanzania umebaini.

Hayo yalisemwa na baadhi ya askari hao wiki iliyopita walipozungumza na mwandishi wetu na kusema kwamba, waajiri wasipokuwa makini katika kuajiri watashangaa kuona wateja wao wanapigwa risasi na kuuawa kila kukicha.

“Haiwezekani kuwa wanaonyang’anywa fedha ni wale wanaotoka kuchukua benki kuliko wanaopeleka! Ina maana wezi wapo katika baadhi ya mabenki hivyo kunatakiwa kuwepo na umakini wakati wa kuwaajiri,” alisema askari mmoja kutoka makao makuu ya jeshi hilo, Dar akiomba hifadhi ya jina lake kwa vile yeye si msemaji.

Afande huyo aliendelea kusema kuwa, baadhi ya wafanyakazi wasio waaminifu wa benki hizo wanapoona mteja anachukua fedha nyingi hufanya mawasiliano kwa njia ya simu kuwaeleza majambazi walio nje namna alivyovaa mteja huyo na kiasi cha fedha alichochukua.
Uchunguzi zaidi unaonesha kuwa, endapo hali hiyo haitadhibitiwa haraka huenda wananchi wakapatwa na hofu ya kuweka fedha zao benki kwa kuogopa kuporwa na kupigwa risasi wakienda kuzichukua.

 Kamanda wa Polisi Kanda Maalum ya Dar es Salaam, DCP Simon Sirro (pichani) ambapo alikiri kuwepo kwa baadhi ya wafanyakazi wenye mtandao na majambazi huku akisema jeshi lake limeweka mikakati kuhakikisha mtandao huo unasambaratishwa mara moja.
“Ni kweli kwamba, baadhi ya mabenki, si yote, yameajiri baadhi ya wafanyakazi, si wote wenye mtandao na majambazi. Kwa hiyo hata wao ni majambazi tu.

“Sasa tumejipanga vizuri ikiwa ni pamoja na kukamata pikipiki zinazohusika katika uhalifu. Pia tumeamua kuweka makachero nje na ndani ya mabenki, wapo polisi wa miguu, pikip iki na magari. Nina uhakika tutawadhibiti,” alisema Kamanda Sirro.

Aliendelea kusema kuwa, majambazi waliopo katika Kanda ya Dar es Salaam waanze kufunga virago kwani bila kufanya hivyo wajue watakamatwa wote na mtandao wao kumalizika. Pia aliwataka wamiliki wa mabenki kuwa makini wakati wa kuajiri wafanyakazi ili kuwapata wenye sifa njema na kuweka imani kwa wateja wao.
Aliyekuwa Kamanda wa Polisi Kanda Maalum ya Dar es Salaam, Kamishina Suleiman Kova aliwahi kutamka kuwa, baadhi ya wafanyakazi wa ndani wa baadhi ya benki wana ushirikiano na majambazi. Akawatahadharisha wamiliki kuwa makini wakati wa kuajiri.

Wadau, habari;
Hapa maeneo yetu kuna msiba umetokea. Marehemu ameuwawa na majambazi. Alichukua fedha (milioni 10) kutoka Benki mojawapo hapa Mlimani City na kuanza safari ya kuelekea huko Salasala ambako alikuwa na shughuli ya ujenzi inayoendelea. Majambazi walimfuata kwa nyuma, walimpita na kumzuia kwa mbele. Majambazi walimtaka atoe 10M aliyochukua Benki kabla ya kumpiga risasi. Walikuwa wanafahamu kiasi halisi kilichochukuliwa!
Siku kama 5 kabla ya tukio hili, tukio lingine lilitokea eneo la Bamaga (mkabala na Hongera bar). Mtu na mke wake walichukua fedha toka benki hapo Mlimani City (13m). Majambazi walimfuata kuanzia hapo Mlimani city hadi huko Bamaga na kumtaka awape fedha. Kumbe alikuwa amezitenganisha; aliwapa laki 5 lakini walipatwa na hasira na kuhoji fedha nyingine ilikuwa wapi. Walimpiga risasi begani. Mke wake akawaongezea laki 1; naye alijeruhiwa kwa risasi wakidai "tunataka milioni 13 zote". Pona yao ni kuwa fedha walikuwa wameificha kwenye booth. Baada ya kuona muda unapita majambazi wakaondoka. Na kwa bahati nzuri majeruhi walipona. Cha kushangaza ni kuwa majambazi hawakujifunika nyuso zao wala hawakuwa na wasiwasi wa kujificha hata kidogo.
Huko nyuma, jirani yetu mmoja (Mama-Joshua) alichukua milioni 4 hapo hapo Mlimani City. Baada ya kufika kwa Kakobe, majambazi walimpita na kumsimamisha baada ya kujifanya kuwa wanamjua. Baada ya kusimama walimtaka awape "awape mzigo aliochukua benki". Hivyo:
1. Mlimani city ni eneo hatari sana kwa ujambazi; kuwa makini unavyokwenda kuchukua pesa hapo.
2. Inaelekea wafanyakazi wa Benki wanashirikiana na majambazi. Hivyo, kitendo cha wewe kwenda kuchukulia fedha ndani ya benki (bulk cash room) hakiwezi kuwa ni cha siri;
4. Epuka kuchukua fedha nyingi benki. Fanya malipo kupitia benki au njia nyingine mbadala;
4. Kama una ujenzi, ni hatari kuwa na kawaida kuwapelekea mafundi fedha kwenye site; tumia M-pesa, tigopesa, nk.
5. Kama umechukua fedha, usikubali kusimamishwa na mtu usiyemjua njiani isipokuwa kama wameku-block na huna jinsi ya kukwepa.

Enough evidence to convict Ruto - ICC

THE HAGUE - Prosecutors at the International Criminal Court will focus on weight of evidence to seek a post-election violence conviction against Kenyan Deputy President William Ruto, one of them said on Tuesday, after multiple witnesses withdrew their testimony.
Lawyers for Ruto and his co-accused, broadcaster Joshua arap Sang, want judges to throw out the crimes against humanity charges against the pair, saying the loss of the six witnesses' testimony has fundamentally undermined the case.
The hearing has become an important test case for the court in The Hague which, since being set up 13 years ago to end impunity for the gravest international crimes, has handed down just two convictions.
Ruto's high-powered legal team, headed by London barrister Karim Khan, scored a victory on Tuesday, persuading judges to allow evidence to be heard in public over the objections of prosecutors who worried a public airing could endanger remaining witnesses.

But prosecution lawyer Anton Steynberg told the court on Tuesday that enough evidence remained to convict Ruto and Sang, accused of stoking ethnic tensions to unleash an orgy of violence that drove their political opponents from their homes after national elections in 2007.
Asked by presiding judge Chile Eboe-Osuji if the quantity of remaining evidence was sufficient, Steynberg said it was.
"The prosecution intends to take the chamber at its word and focus not on the credibility, reliability and cogency of the evidence but rather on whether the quantum of the evidence may be enough to establish the guilt of the accused," the prosecutor said.
Steynberg cited satellite evidence showing that levels of fire outbreaks in the town of Eldoret had reached an all-time high on January 1, 2008 at the peak of the violence, in which 1,200 people were killed.
"Given the violence that was taking place at the time, it is unlikely that farmers had chosen at that moment to burn shrub," he said, adding that 506 buildings in the town had been aflame.
Ruto's legal team will seek to persuade judges later this week that there is no case to answer.
The ICC was forced to drop charges against Kenyan President Uhuru Kenyatta last year following witness withdrawals, which prosecutors they blamed on intimidation.

Pia amesema kuwa pamoja na sheria hizo kuchukuliwa watafanya operasheni maalumu katika eneo hilo na kutafuta namna nzuri ya kuondoa pikipiki katika maeneo hayo.

Katika Operasheni zilizofanywa na Jeshi hilo wamefanikiwa kuwakamata majambazi nane pamoja na kumamata Bunduki mbili aina ya Pump Action ambazo namba zake zilifutwa na kukatwa Mtutu.
Aidha Kamanda Sirro amesema kuwa katika Operasheni hiyo wamemkamata jambazi aliyekuwa akitafutwa kwa muda mrefu anayejulikana kama Mkama Hassan mkazi wa Gomgolamboto jijini Dar es Salaam na alipopekuliwa alikutwa na Bastola aina ya Chinese iliyofutwa.

Mtu mmoja aliyefahamika kwa jina la Nzuri Ndizu (44) Mkazi wa Kijiji cha Mbede Wilaya ya Mlele Mkoani Katavi amekamatwa akiwa na meno ya Tembo nane yenye uzito wa kilogramu 50 yakiwa na thamani ya shilingi milioni 120 ambapo ni sawa na Tembo wanne waliuawa.

Kamanda wa Polisi wa Mkoa wa Katavi Dhahiri Kidavashari aliwaambia waandishi wa Habari kuwa mtuhumiwa huyo alikamatwa mida ya saa tatu na nusu .

Kidavashari alisema mtuhumiwa Ndizu alikamatwa kufuatia misako na uparesheni mbalimbali zinazoendelea kufanywa na Jeshi la Polisi ikiwa ni kuhakikisha wahalifu wa makosa mbalimbali wakimemo wawindaji haramu wa wanyama pori wanakamatwa.

Siku hiyo ya tukio jeshi la polisi lilipata taarifa toka kwa Raia wema kuwa katika pori la akiba la Lwafe kuna watu wanajihusisha na biashara haramu ya meno ya Tembo .

Kidavashari aliendelea kuwaambia waandishi wa Habari baada ya taarifa hizo kupokelewa ufuatiliaji ulifanyika kwa polisi kufika kwenye eneo hilo na kuweka mtego ambapo walifanikiwa kumkamata mtuhumiwa huyo Nzuri Ndizu akiwa na meno ya Tembo vipande nane akiwa ameyaficha kwenye pori kwa ajili ya kusubiria wateja .

Kamanda Kidavashari alisema mtuhumiwa anaendelea kushikiliwa na jeshi la Polisi kwa hatua za upelelezi zaidi ilikuendelea kubaini mitandao yote inayojihusisha na biashara hiyo haramu ya meno ya Tembo na kufikishwa Mahakamani baada ya upelelezi kukamilika.

For a good period of time, the senseless, fearless investigative journalist Mohammed Ali, better known in the circles as Moha Jicho Pevu drawn from his facts hitting and explosive expose piece-Jicho Pevu a programme has since revolutionized the Investigative journalism in Kenya.
Moha has become punching bag especially for the reigning regime’s leaders and their followers.
The indomitable journalist, in numerous occasions have been labelled a terrorist sympathizer from what the system’s cohorts want him to be seen as given his exposes that have criticized the government and poked loopholes in the fight against terrorism. All these attacks yearn for the biggest question. What is it with Mohammed Ali that is making the jubilee government overwhelmingly disturbed. According to close sources to the highest office in the land, several schemes have been dispatched in a bid to discredit one of the most trusted journalist in Kenya owing to his undisputed investigative pieces.
Why would they break arms to discredit him? Inside sources confirms months of speculations that Mohammed Ali is arming himself for entry into active politics which means he’ll dump his journalism career anytime soon. His anticipated entry into politics is giving jubilee’s strategists hell of a time as this would change the whole picture and how politics is played in Kenya.
Moha is seen leaning more towards the opposition leader Raila Odinga who’s also pumping to have his most crucial shot in the incoming presidential elections. The government’s operatives are more than shaken that Moha’s entrance into Tinga’s team will not only change the campaign game but also undo months and years of their ‘hardwork’.
While it’s still not clear where Ali will be vying, sources close reveal he will be going for Nyali constituency seat. However, what’s giving the government’s wreath is his relevance in the larger national political scene.
There are genuine fears that Ali’s entrance into politics would shake the Muslim voting block and reshape their voting patterns. It is feared that his defiant voice will be more relevant to the discriminated Muslim society who feel less Kenyan and form a bigger voting block. Currently, the Muslim community lack a visible vocal advocate for their rights a void that Moha can easily fill and own. In the case this happens, the Muslim voting block will shift allegiance and now you see why the system is worried.
The Muslims have genuine issues they’ve been crying out on from unwarranted arrests to extrajudicial killings to isolation in development especially in the North Eastern regions which is also hit with lack of ID issuance epidemic. In general, the normal Muslim in the community has a genuine discriminatory issue to raise. These leaves them vulnerable to any strong voice to fight for their rights and space in Kenya, this is where Moha comes in and hell for the Jubilee government.
Similarly, the youths, who forms majority of the population in Kenya and also eligible voters would easily identify with Moha. There are fears that a revolution would be sparked and who else would lead such a course of not fearless, respected head as Mohammed Ali. The youths of this country have often been told they’re the leaders of tomorrow, a day that never came and now going for the leadership posts themselves.
Have you ever thought the impact it would make if the youths of the country rose above limits to bring change? All that is needed are young blood courageous enough to start the fire and this what worries the jubilee operatives most as Moha seems from his frequent declaration that he’s at war with the dragging regime. They’re afraid he will influence the youths to rebel against the sitting government and gunner enough votes to ouster them from power.
In the final analysis, Mohammed Ali has a national trustworthy face, thanks to his excellent jobs on the media that has earned him the trust from many Kenyans. Jicho Pevu, a show that he pioneered is seen as the truth speaker in Kenyan media, imagine that effect on politics. Moha as a public figure, currently enjoys a national level look, this will fuel a major boost to Raila’s campaign and duel major pain to the government who will now have difficult time in countering his influence.
According to talks in the CORD corridors, Moha is expected once making it official to joining politics to head a revolutionary team that will hold the government head on as the electioneering period catches fire.
There is unease in the government’s circles that Moha’s face as a trusted public figure would deal the jubilee team a major blow especially in the nation phase. Despite all the threats and attacks from obvious quarters, the fearless journalist is not getting off his seat anytime soon.
His pursuance for justice that has put him in the bad books of the government doesn’t seem to be catching cold any minute as he comes out more defiant towards the current regime which he believes is dragging Kenyans back to the bad days. Should Moha be a worried man? I end it with his own words ‘You can’t kill a dead man, I’m ready to die. We will get back this country to where it should be’ “We will make this country great, one day”.

Alisema Mahende alifunga mlango wa geti, walipokuwa wanagomabana chumbani, ambapo alikuwa akimpiga mkewe na kitu chenye ncha kali.
“Walikuwa wanagombana mara kwa mara. Baada ya kuona ugomvi huo umechukua muda mrefu, tulikwenda kuchungulia dirishani kwake ndipo tukamwona anachoma mwilini kwa kutumia kitu chenye ncha kali ambacho kipo kama chuma,” alisema.
Aliongezea kuwa: “Walikuwa wakitoka chumbani na kukimbilia sebuleni. Tulishindwa kumwokoa huyu mama kwa kuwa mlango ulifungwa na jambo lingine ni kwamba huyu baba ni mkali hivyo tukawa tunaogopa,” alisema.
Kwa mujibu wa shuhuda huyo, ugomvi huo ulidumu kwa zaidi ya saa mbili na baada ya muda, alifanikiwa kutoka nje ambapo aliweza kupiga hatua tano na kuanguka na ndipo mtuhumiwa huyo alipomfuata na kumpiga na kitu chenye ncha kali kwenye kisogo.
Baada ya kufanya hivyo, alisema mtuhumiwa alichukua panga na kuanza kumcharanga mkewe kisogoni na hatimaye kupoteza maisha majira ya saa nane usiku.
Alisema baada ya kufanya hivyo, mtuhumiwa alimfunika mkewe na kwenda kupiga deki chumbani kwake kuondoa damu zilizokuwa zimetapakaa. 
Shuhuda huyo alisema mtuhumiwa alikwenda kujisalimisha kituo cha polisi cha Sitakishari na baada ya muda mfupi, alirudi nyumbani na kuondoka tena ilipofika saa 12 asubuhi.
Gazeti hili lilizungumza na ndugu wa karibu wa mtuhumiwa ambaye hakutaka jina lake liandikwe gazetini, ambaye alisema tukio hilo limewasikitisha kwa kuwa alivyopatiwa taarifa hawakuamini kilichomkuta ndugu yao.
Alisema alipatiwa taarifa saa nane usiku wa kuamkia Jumatatu ambapo ilimbidi afike eneo la 

tukio kujionea hali ilivyokuwa.
Ndugu huyo alisema alipofika eneo la tukio, alikutana na kaka wa mtuhumiwa na mtuhumiwa mwenyewe ambapo walimwuliza ni kitu gani kilichomkuta na kueleza kuwa tayari ameshammaliza bila kutaka kutoa maelezo ya kile kilichosababishia.
Alisema anachoelewa ni kwamba watu hao wawili walikuwa na ugomvi wa muda mrefu, baada ya mtuhumiwa kuoa mke wa pili.
Kwa mujibu wa ndugu huyo, marehemu enzi za uhai wake alikuwa akidai apatiwe nyumba hali na baada ya kuona hatimiziwi matakwa yake, aliamua kufungua kesi mahakamani.
Hata hivyo, alisema mtuhumiwa alishakubali kutoa nyumba na kwamba kesi hiyo ambayo ilikuwa itolewe hukumu Januari 27, mwaka huu, alikuwa akabidhiwe hati ya nyumba kama aliyodai.
Licha ya kwamba suala hilo liko mahakamani, mkewe alikuwa akijitapa mtaani kuwa atahakikisha anamkomesha mumewe na kwamba akishapatiwa nyumba hiyo ataiuza.
“Huyu mkewe alishaambiwa anapatiwa nyumba lakini kila kukicha ni visa anaanzisha. Mara aende kazini kwa mumewe kumsemea maneno ya uongo. Pia kila mwezi mumewe alikuwa anakatwa Sh. 200,000 na kodi ya nyumba alikuwa anapokea lakini mumewe alipokuwa anarudi kutoka kazini, alikuwa hakuti chakula.
Naye Mjumbe wa Shina Na. 17 la mtaa huo, Jackson Mathayo, alisema kuwa tukio hilo limewaumiza na kwamba tatizo lililojitokeza ni kukosa taarifa kwa wakati.
Alisema alifika eneo la tukio na kushuhudia mwili huo ukiwa na majeraha sehemu mbalimbali za mwili huku maeneo ya kichwani yakiwa yamepasuliwa kwa panga.
Mathayo alisema mtuhumiwa baada ya kufika kituo cha polisi alirudishwa na kutakiwa kupeleka barua ya mjumbe inayothibitisha kuwa kafanya tukio hilo.
“Nimesikia kuwa alisema nimeua. Wale askari hawakuamini kwa kile alichokizungumza maana alikuwa anazungumza kama ni jambo jepesi na hakuwa na hofu ndiyo maana akaambiwa apeleke barua ya mjumbe,” alisema.
Baada ya kuambiwa hivyo, alisema alikwenda kwa balozi na kumweleza kuwa: “Mimi nimeshaua. Alipoulizwa tatizo ni nini alisema tayari ameua,” alisisitiza.
Mathayo alisema balozi hakuamini ikabidi amjulishe na mjumbe mwingine kwa ajili ya kwenda eneo la tukio kushuhudia suala hilo.
Alisema baada ya kushuhudia tukio hilo alipatiwa barua na kuipeleka kituo cha polisi ambapo wamemshikilia hadi sasa.
Naye Amina Sulemain ambaye ni jirani wa mtuhumiwa, mtuhumiwa huwa ana hasira za haraka, hivyo huenda mkewe alimpa majibu mabaya hali iliyosababishia kutokea kwa mauaji.
Mwili wa marehemu uliagwa jana saa sita mchana kwa ajili ya mazishi ambayo yatafanyika mkoani Mara. Familia ya mtuhumiwa haikusafiri na mwili wa marehemu kwa kuhofia huenda watalipiziwa kisasi.

OPENING REMARKS
Ladies and Gentlemen:
I meet you today with a heavier agenda than the ones we have shared in recent years. I am here to discuss the Grand Robbery of Kenya by agents of the State, through the much talked about Eurobond.
Hopefully soon, we will meet again to discuss some more pleasant subject. For the past month or so that I have talked about the Eurobond, I have mainly raised questions. Today I am responding to the answers, actually the thread of lies, the scheme of deception, smoke and mirrors provided by the National Treasury to our own tax payers and to the international community that showed faith in our country and participated in the bond.
I pledged to Kenyans, and I pledge again now, that I will not rest until we get to the Bottom of this “Eurobond” matter. Until responsibility is assigned and punishment to fit the crime is awarded.
Because this matter is weight, because our dignity and integrity as a nation is at stake, because the future of our children and grand children is caught up in this deadly debt, we have gone all out to engage a Consultant to provide expert evidence on this record breaking robbery.
I shall introduce Kenya’s Eurobond in broad terms. The Consultant will then give a detailed presentation on various aspects of the Eurobond. I will then make concluding remarks. Then I will take your questions.
 believe that in the Eurobond saga, we are staring at theft of public resources on a scale never seen before in our country.
The theft has been achieved through international money laundering by elements of the Jubilee Administration, working in cahoots with leading international banks and money laundering experts.
The theft has been executed with the collaboration bankers, lawyers, accountants and a network of intermediaries operating from Nairobi, London, New York, South Africa and even Qatar. The size and scale of money at stake at USD1 billion dwarfs all previous scandals in Kenya.
The crimes we are dealing with in this scam are universally agreed to be grim ones that pose grave danger to international stability and economic progress to the whole world. The money raised from international investors with very noble intentions has not ended up in the right accounts for the intended purposes, which raises the spectre of a classic international money- laundering scheme.
In fact, today, we are questioning whether this money came to Kenya at all. I wish to give you just a bit of history of this saga. The Eurobond saga was preceded with much drama. It began in May 2014 with President Uhuru Kenyatta ordering the payment of debts owed to companies in the Anglo Leasing scam that was pulled on Kenyans many years earlier. We were told payment of those debts would pave way for Kenya to borrow from the international markets.
The payment paved way to the launch of the bond with much fanfare in June 2014. The President assured Kenyans that the loan would make the government stop borrowing from local markets; it would help lower interest rates and lower inflation and cost of living.
Kenya’s first Eurobond Issues was trumpeted as the largest and most successful in Sub Saharan Africa (outside South Africa).
The National Treasury mounted a series of high profile international road shows in leading capitals of finance in Europe and North America to drum up support for the debut Eurobond issue. The results were overwhelming.
International Investors eagerly bought the “Kenya Rising” story. Kenya’s Eurobond accordingly attracted bids of 8.8 billion US dollars billion. The Government accepted bids totaling 2 billion US dollars in June 2014. In December 2014 the Government returned
to the international capital markets and raised a further 815 million US dollars in a Tap Sale, benefiting further from positive
sentiment from investors. The proceeds from the Tap Sales were received in an account at Citibank New York.
The Prospectus stated one of the purposes of the Eurobond Issue was to repay the Syndicated Loan of 604.6 million US dollars.
The most important justification for the Eurobond was to bring down the domestic interest rates and fund the country’s ambitious infrastructure programs in energy, roads and ports.
On 24th June 2014, the full amount of 2billion US dollars was duly received at the main collection account held by JP Morgan
Chase Bank in New York. After deductions of minor fees and charges the Net Proceeds were acknowledged as received on that date.
On 3rd July 2014, two electronic withdrawals were made from the JP Morgan Chase Bank account. Then, first, some 604.6 million US dollars got wired to Standard Chartered Bank in London, which was described as a repayment of the syndicated loan. Secondly, some
395.4 US dollars was transferred directly back to Kenya and deposited into the Consolidated Fund on the same day.
On 8th September 2014, the balance on the JP Morgan Chase bank account amounting to 999 million US dollars was transferred to an account at a the Federal Reserve Bank, New York. This is according to a swift transfer statement posted on the National Treasury’s
website. It’s from this point that all hell breaks loose. The detailed part of this presentation will take you through what went horribly wrong.
TRACKING THE EUROBOND PROCEEDS
We have dutifully and diligently studied the movement of Eurobond proceeds. The presentation that follows will show the following: That there are no bank statements or third party evidence of what happened to the money deposited into the account at the Federal Reserve Bank of New York. That the proceeds of the Tap Sales of 815 million US dollars were received in Kenya, and were eventually deposited into the Consolidated Fund as required by law.
An amount of 999 million US dollars has to date not been deposited into the Consolidated Fund as required by Law. Nobody knows whose account it ended up in or whether it came into Kenya at all.
Finally, that the National Treasury has been engaged in an elaborate scheme of deception intended to mislead the Kenya taxpayers that the proceeds of the Eurobond were deposited into the Consolidated Fund, even where there is clear evidence to the contrary.
HOW THE NATIONAL TREASURY BROKE THE LAW.
The National Treasury did not pay immediately into the Consolidated Fund, the Full Amount of the Net Proceeds of the Sovereign Bond of US$1,999,052,872.97 (KSh.173, 917,599,948.39 which were received on 24 June 2014. This is a breach of Article 206(1) of the
Constitution and the PFM Act Section 50(7)(a). The National Treasury did not obtain the approval of the Controller of Budget, a Constitutional Office Holder, Prior to making withdrawals from the Net Proceeds of the Eurobond when effecting the repayment of the Syndicated Loan. This is a breach of Article 206(4) of the Constitution. As an interesting aside please note that the Controller of Budget has issued public statements contradicting her Official Reports to Parliament for FY 2013/14 and FY 2014/15. The National Treasury is also in breach of Article 221(6) of the Constitution, as a direct consequence of the failure to pay the proceeds of the Eurobond in full into the Consolidated Fund.
The key players; the persons of interest in this saga of deceit, collusion and cover up are:
1. Mr Joseph Kinyua, Chief of Staff, the Presidency and Head of Public Service.
2. Mr Henry Rotich, the Cabinet Secretary to the National Treasury.
3. Dr Kamau Thugge, the Principal secretary to the National Treasury.
4. Mr Jairus Mohammed Nyaoga, Chairman, Board of CBK.
5. Prof Njuguna Ndungu, Former Governor, CBK.
6. Mr John Birech, Director, Financial Markets, CBK 7. Moses Muthui, Manager, Financial Markets, CBK
8. Mrs Agnes Odhiambo, Controller of Budget.
9. Mr Bernard Muiruri Ndungu, Chief Accountant, the National Treasury. 10. Mr Julius M. Kilinda, Accounting Unit, the National Treasury.
The scheme is so elaborate, so thick and so reckless that we believe these officers acted for or on instructions from bosses
higher up the Executive ladder. Your guess is as good as mine on who the owners of the plot really are. We shall take you through the elaborate Scheme of deception where the National Treasury issued a series of transfer instruction letters purporting to show that all the Eurobond Proceeds were transferred into the Consolidated Fund, in the face of clear evidence from the gatekeeper of the Consolidated Fund (the Controller of Budget) that not all proceeds were deposited into the Consolidated Fund. FAKE TRANSFER INSTRUCTIONS, MULTIPLE OPAQUE REVENUE COLLECTION ACCOUNTS, CLAIMS OF EXPENDITURE ON NON- EXISTENT PROJECTS AND UNSUPPORTED EXPENDITURE.
Eurobond Proceeds moved through a bewildering array of opaque collection accounts with descriptions changing at the whims of Treasury Mandarins ranging from “Special Accounts”, to “Offshore Accounts: and “Sovereign Bond Account.”
We remain concerned that to date the National Treasury has been unable to credibly explain to Kenyans where the so-called Eurobond money went to, and in particular, which projects were funded by the proceeds of the Eurobond issue. We have the bizarre situation where the National Treasury Cabinet Secretary in one breadth insists before the Parliamentary Accounts Committee that all Eurobond proceeds were deposited into the Consolidated Fund. Yet, in the same breadth, the Office of the Attorney General argues, in a letter to the Law Society of Kenya, that depositing monies into the Consolidated Fund is optional.
By the Treasury’s own admission 395 million US dollars from the Eurobond Proceeds received on 3rd July 2014 after the end of the FY 2013/14 were spent on infrastructure projects.
Since the revenue were received after the close of the year and spent again after the close of the financial year, they were not covered by Appropriations in respect of the year. Such expenditure represents unbudgeted for expenses.
The same National Treasury admits obtaining approval from Parliament to borrow KSh.141bn under the Sovereign Bond in 2014/15.
The Purported Transfer Instructions from the so- called Sovereign Bond Account (Account 1000212764) add up to KSh.162.2 billion. The Sovereign Bond Amounts that were not deposited into the Consolidated Fund totals KSh.141
billion. Something went horribly wrong, and it appears to have been designed to be so.
CONCLUDING REMARKS OF HON RAILA ODINGA AT MEETING WITH MEDIA PRACTITIONERS; JANUARY 14, 2016;
Ladies and Gentlemen;
We are convinced that we are in the middle of a great con game, treachery and thievery by the agents of the Kenyan state working in cahoots with international actors.
We are therefore making demands to prevent a repeat and ensure the criminals are apprehended and punished. Here are
our demands: We demand that Top National Treasury officials, namely the Cabinet Secretary Mr. Henry Rotich, the Principal Secretary
Dr Kamau Thugge and the Accountant General Mr. Bernard Ndungu RESIGN IMMEDIATELY and be arraigned in court for committing the following acts or omissions:
Undermining the Constitution by refusing to deposit the Eurobond proceeds immediately and in full into the Consolidated Fund. Concocting documents to cover up a massive loss of Public Funds. Deliberately misleading the Public Accounts Committee and taxpayers that the Eurobond Proceeds were paid in full into the Consolidated Fund. We demand that the Federal Reserve Bank of New York explains the veracity of the swift transfer document posted on the National Treasury’s website stating that a sum of 999 million US dollars from the Eurobond Proceeds was deposited in an account with the bank on 8th September 2014.
The Federal Reserve Bank of New York should give a full account of where the Eurobond Proceeds went after they were deposited in that account. We challenge the Federal Reserve Bank of New York to come out clearly and demonstrate that it was not a party to
what is clearly an elaborate money laundering scheme by producing Bank Statements detailing movements of the Eurobond proceeds deposited in the Account between 8th September 2014 and 30th June 2015.
The JP Morgan Chase Bank (Johannesburg) Branch must account for the authenticity of the bank statements posted on the National Treasury’s website purporting to show that the Kenya Eurobond proceeds were deposited with them instead of the Parent Bank in New York. The bank must explain whether it is their practice to issue bank statements for clients who are customers of their Parent Bank in New York.
DEMANDS ON THE PRESIDENT
We demand that President Uhuru Kenyatta declares the Eurobond matter as a National Disaster and consequently undertake the following:
1. Institute an independent international Forensic Audit to completely track and trace the whereabouts of 999 million US dollars of the Eurobond Proceeds that were not paid into the Consolidated Fund.
2. Institute an audit of expenditure allegedly funded by the Eurobond proceeds; the Treasury Single Account (TSA) to remove the plethora of opaque revenue collection accounts (such as the so called “Sovereign Bond Account”) through which corrupt government officials divert revenues into before revenues are paid into the Consolidated Fund.
Indeed, under the IMF’s Precautionary Facility that Kenya signed up to in February 2015, the government committed to set up the Treasury Single Account.
4. Hasten the establishment of the Office of Management and Budget that the President announced on 24 November 2014 to tighten controls and oversight over National Government revenues and expenditure.
The Eurobond saga has exposed a shocking lack of capacity in accounting and financial management at the National Treasury. President Uhuru Kenyatta must declare this material deficiency in accounting and public financial management a National Disaster and shame; and consequently undertake the following:
1. Appoint persons with deep knowledge and experience of accounting and financial management to the highest levels of the National Treasury;
2. Restore the independence of the Office of the Auditor General (including over its Budgets and staffing) by removing this office from the Executive arm of government and transferring it to the National Assembly. Indeed that is the practice in Presidential Systems for example the USA where the General Accounting Office (GAO) falls under Congress, and is therefore insulated from
interference by the Executive arm of Government;
3. President Uhuru Kenyatta must declare IFMIS a big failure, a sham, and scandal and task the National Treasury with implementing a world class and robust accounting system consistent with generally accepted public accounting standards. Indeed it would have been
easy to account for and trace the Eurobond proceeds if the Treasury had a world class and truly integrated financial and management information system – the very acronyms of IFMIS.

Mara baada ya kukosa tuzo ya mchezaji bora wa dunia (Ballon d’Or) iliyochukuliwa na mpinzani wake wa muda mrefu Lionel Messi, mshambuliaji wa Real Madrid na nahodha wa Ureno alionekana katika morali ya juu kabisa mara baada ya kupost picha katika mtandao wake wa Instagram akiwa ameketi na gari mpya aina ya Porsche Turbo S yenye thamani ya dola 146,000 za Marekani.
Ronaldo mwenye miaka 30 hivi sasa, alikosa tuzo hiyo ambayo ingekua ni ya nne kwake kama angetwaa laikini aliishuhudia ikienda kwa Lionel Messi wa Barcelona na kumfanya muargentina huyo kufikisha tuzo 5 tangu alipochukua 2009, 2010, 2011, 2012 na 2015.

SERIKALI nchini imetangaza kuifungia kampuni ya simu ya six Telecom pamoja na kuifungulia jarada la kiuchunguzi polisi, baada kubainika kuwa ilikosesha serikali mapato yaliyotokana na kodi yanayofikia bilioni 8.5 pamoja na kutoza gharama ya simu kwa  wateja  kwa kiwango cha chini tofauti na ile iliyopangwa na serikali.
    Hata hivyo,Serikali pia imetangaza kuzifungia redio 28 nchini baada ya kushindwa kulipia ada ya reseni.
   Akitangaza uaamuzi huo,leo jijini Dar es Salaam wakati wa mkutano na waandishi,Waziri wa Ujenzi,Uchukuzi na Mawasiliano,Profesa Makame Mbarawa  amesema serikali imefikia uamuzi wa kuifungia  Kampuni hiyo ya simu baada ya kufanya makosa mbali mbali,
    Waziri Mbarawa ameyataja makosa hayo kuwa  ni kuikosesha mapato serikali yaliofikia billion 7.2 na  kukataa kulipa ada ya reseni ambayo ni bilioni 1,pamoja na kugoma kulipa toza ya faini ya milioni 361.25
   “Kwaanzia sasa tumeifungia kampuni hii ya Six Telecom baada ya kukiuka sheria mbalimbali ambapo Kampuni hii ya simu ilisajiliwa kutoa huduma  mwaka 2013,lakini ikaanza kukiuka kanuni  za Mamlaka ya mawasilioni nchini (TCRA) ambayo iliweka kiwango cha chini  cha gharama kwa kupiga simu nje ya nchi wakati ilitakiwa kutoza gharama kubwa,”
 “Licha kutoza kiwango  hiki cha  chini ya  kiwango pia imeshindwa kulipa kodi  ya Bilioni 7.2  pamoja na kukataa kulipa  gharama za reseni inayofikia bilioni 1 na kushindwa  kulipa faini ya milioni 361.25 iliyotokana kukiuka  kanuni za huduma hiyo”amesema Mbarawa.
   Vilevile,Waziri Mbarawa ametangaza kuzifungia rasmi redio 28 nchini baada ya kushindwa kulipa  ada ya reseni  kwenye Mamlaka ya Mawasiliano nchini TCRA jambo analodai  kuwa ni kosa.
“Tumezifungia redio 28 ambazo Kesho (TCRA) watazitaja kwa majina,kwani redio hizi zimeshindwa kulipa ada ya reseni ambapo kisheria wanatakiwa kulipa,lakini redio hizi zilishindwa kulipa ”amesema Waziri Mbarawa
